Minutes of a regular City Council Meeting held in the Council Chambers of City Hall, Lincoln, IL, on Monday, January 7, 2008.

Mayor Davis-Kavelman called the regular City Council Meeting to order at 7:15 p.m. City Clerk Ms. Riggs called the roll. There were nine Aldermen present (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs) and one absent (Alderman Prather). Also present were Assistant Fire Chief Martin, Police Chief Erlenbush, Street Superintendent Mr. Jackson, EMC Manager Mr. Kitzmiller, City Engineer Mr. Mathon, and Safety and Building Officer Mr. Last. Also present were City Attorney Mr. Bates, City Treasurer Mr. Plotner, City Clerk Ms. Riggs and Mayor Davis-Kavelman.

Those present recited the Pledge of Allegiance to the Flag led by Alderman Rohlfs.

Mayor Davis-Kavelman called for the Presentation of the Minutes:

Alderman Anderson said it was pointed out to me by Alderman Horn that there are two errors in the December 17, 2007 minutes on the first page the very last paragraph should say Mayor Pro Tem and there is also the same error on the third page the very first paragraph should also say Mayor Pro Tem and I would make a motion to approve these minutes with those corrections and Alderman Busby seconded it. There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, and one absent (Alderman Prather); motion carried.

Mayor Davis-Kavelman asked for the Presentation of Petitions:

City Clerk Ms. Riggs said there were no Petitions to come before the City Council.

Mayor Davis-Kavelman asked for the Presentation of Communications:

Mayor Davis-Kavelman said we did have one issue and since we have Mayor Martin here from Atlanta, Illinois. Mr. Bates asked Mr. Martin if he was heading up that CYPRAY with the 911 board request. Mayor Martin said no.

Mr. Bates asked who that was. He asked if anyone could remember. We authorized someone to act and I thought it was you.

Mayor Davis-Kavelman said we received a nice check in the mail and we were going to tell you thank you.

Mr. Bates said the mayor just handed me a letter from the Northwest Municipal Conference there's been an order entered in that case of Primeco Communications with respect to the petitions that were filed for CYPRAY funds and if I remember right the Logan County ETSB board submitted a joint application involving Atlanta, Beason, Chestnut, Elkhart, Emden, Hartsburg, Latham, Lawndale, Lincoln, Middletown, Mt. Pulaski, New Holland, and San Jose requesting funds that I don't know how much was requested but there is a check here payable to the City of Lincoln for $31,431.77 that we were awarded for that request.

Mayor Davis-Kavelman said we would like to thank you. Mr. Bates said that is the money for the joint do you remember how much that application was and was that how much it was. Mayor Martin said no, I don't to tell you the truth. Mr. Bates said I don't either but I suspect that's how much it is for. Mayor Martin said that is the total and you probably better check with Dan Fulscher on that.

Mr. Bates said he may be down here before this meeting is over if he is watching it on TV. He said if you will remember we talked about that it was the very complex litigation where the city actually had to pay a substantial amount of money back for the predecessor to the telecommunications tax, Mr. Plotner is that right.

Mr. Plotner said I think that's right. Mr. Bates said simplified telecommunications tax and we were hopeful that somehow the money would come back and apparently a good chunk has and that request has apparently been approved and we have the money.

Mayor Davis-Kavelman said the other thing and this is kind of tacky but I am a new grandmother so I wanted to show my new little girl. Avery Marie Davenport she was born December 21, 2007 and she is my first little grandchild.

Mayor Davis-Kavelman asked for the Presentation of Bids:

City Clerk Ms. Riggs said there were no Bids to come before the City Council.

The Mayor then asked for the Presentation of Ordinances and Resolutions:

Truancy Ordinance tabled on December 3, 2007

Alderman Neitzel said I am leaving that on the table. I do at this time I want to say at this time that I have arranged for a meeting at 6:15 p.m. January 15, 2008 with Jean Anderson and the home school committee at the council.

The Mayor then asked for the Presentation of Claims, Presentations, Reading, Reference and Reports Thereon:

Alderman Anderson made a motion by Roll Call to approve all claims as presented: Finance, Policy & Procedure, Sanitation, Insurance, and Grounds, Buildings & Local Improvements Committees' Reports by roll call and Alderman Busby seconded it. Roll Call. There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, and one absent (Alderman Prather); motion carried.

Mayor Davis-Kavelman then asked for the Presentation of Official Reports:

City Clerk's Report for December, 2007 was handed out for tonight's meeting.

Mayor Davis-Kavelman asked for the Presentation of Special Reports:

The written Police Department Report for November, 2007 is on file.

Mayor Davis-Kavelman asked for the Presentation of Unfinished Business:

City Clerk Ms. Riggs said there was no Unfinished Business to come before the City Council.

Mayor Davis-Kavelman asked for New Business:

City's Financing of the Logan County Economic Development Partnership

Mayor Davis-Kavelman said Alderman Prather is not here tonight and he is Finance Chair and I think this is important for him to be here so we will leave that on the table, if that is alright with the City Council.

Mayor Davis-Kavelman said I would like to leave that on the table as well. We have a meeting on Thursday.

Mr. Bates said I would just like to point out is on the meeting schedule we have a hearing scheduled on an annexation matter on First Baptist Church at 7:00 p.m. next Tuesday night. That has been published I was absent but I believe the Planning Commission has already considered that.

Mr. Last said yes. Mr. Bates said was it approved. Mr. Last said yes.

Mr. Bates said that matter will probably come before the voting session Tuesday, January 22, 2008 for both the Annexation and the Rezoning. I won't be here that night I will have all the paperwork ready.

Alderman Huskins made a motion to adjourn and Alderman Tibbs seconded it. There were nine yeas (Alderman Anderson, Alderman Armbrust, Alderman Busby, Alderman Hoinacki, Alderman Horn, Alderman Huskins, Alderman Neitzel, Alderman Rohlfs, and Alderman Tibbs), zero nays, and one absent (Alderman Prather); motion carried.

The City Council Meeting was adjourned at 7:21 p.m.
